Family Law
The area of Family Law is constanly changing. New legislation and court rulings
require knowledge and current updated information to competently represent clients. Mr. Macaluso offers extensive experience in the following areas:
- Divorce (Dissolution of Marriage) - addressing issues of alimony, property distribution, child custody and support, visitation, residency requirements, out of state relocation.
- Post Dissolution Child Custody, Support and Visitation - Changes often occur in clients' family, work and financial lives after a divorce. Mr.
Macaluso has substatial case experience dealing with these "change of circumstance" situations. He also has extensive knowledge or HRS hearings and DOR support collection matters.
- Modification of Final Judgement - As life circumstances change, clients may wish to modify prior Final Judgements of Dissolution.
Prenuptual Agreements - agreements between persons seeking to be
married. These agreements manage financial issues and/or other personal circumstances in the event of a divorce.
- Postnuptual Agreements - formalizing agreements between spouses regarding financial issues or other personal circumstances in the event of a
divorce; such agreements attempt to keep the focus on maintaining the maital union.
- Paternity Determination - a matter brought into court to determine the identity of a child's legal father; either the biological father or mother can initiate a paternity action.
- Name Changes - a court procedure to change a person's name for any lawful purpose such as restoring a woman's maiden name following a divorce or children assuming the suranme of step-parents.
- Guardianships - Guardianships can be established when a person has become incompetent (person/property), or where a minor child is not legaly competent to handle his/her affairs.
- Grandparents' Rights - Actions can be brought before the court to petition for visitation and/or custody of grandchildren.
- Domestic Violence Injunctions - actions brought before the court to prevent or further prohibit acts of domestic violence or to defend against an
improper action brought against a person. Either spouse or partner in a relationship can initiate this type of action.
